Cubble - Terms and ConditionsGeneral These Terms and Conditions and other policies stated on Cubble constitute the entire agreement between you and Cubble and supersedes all prior agreements. These Terms and Conditions are governed by Dutch law. If we do not enforce a provision, this implies that we do not waive the right to a later time to do. If any of these Terms and Conditions will be declared invalid by the court it cannot affect the remaining Terms and Conditions. We may change these Terms and Conditions of right and discretionary transfer by the following notice. Notices to you will be send to the given email address, or by post. Notices given by post will be deemed to be received five days from the date of dispatch. We can always change these Terms and Conditions, or what changes when you place an ad or within thirty days of entry into force, whichever event occurs earlier. Any other amendment of these Terms and Conditions will be effective only if in writing and signed by users and by us. All privacy-sensitive information that you provide to us is subject to the Privacy Statement. Cubble will do its best to treat this information confidential and only use it for purposes as defined in our Privacy Statement. Cubble works according to the Dutch privacy legislation.Using Cubble You place an ad in the appropriate category and it will not: - act in violation of any law and regulations and/or our policy as stated in these Terms and Conditions;- state false or misleading information;- act in violation of any rights of third parties;- distribute messages that contain spam, chain letters or include pyramid schemes;- include viruses or other technology that could damage Cubble or the interests or property of users of Cubble;- burden the infrastructure of Cubble unreasonable or disrupt operation of Cubble;- copy, edit, or disseminate any content or third party personal data;- collect information about others, including e-mail addresses, without their consent;- attempts to bypass restrictions regarding gaining or preventing access to Cubble.- distribute information of an established company with a commercial purpose using a Cubble student account. This may lead to a fine of €1,000- per ad posted and the immediate removal of the account including advertisements.Abuse of Cubble For reporting illegal and infringing advertisements and other problems or offensive content, please use the contact form. So we can work together to ensure that the site is as clean and safe as possible. You can also register complaints about scams by contacting Cubble.If we have evidence from other users or other reasons to believe that some users cause problems or not act in accordance with the letter or spirit of our policy as stated in these Terms and Conditions, we can - if we warranted see - the following measures:- We may limit or terminate our service and remove hosted content;- We may take technical, legal and legislative measures in order to prevent users from Cubble;- To protect Cubble and its users and to prevent fraud, we may process your personal data as explained in our Privacy Policy;- We may provide your personal information to certain third parties (such as police, justice and rights holders). Obviously, within the limits of what the law allows us and as explained in our Privacy Policy.This list is not exhaustive. In some cases it is possible that the law allows us to take other measures. Whether or not we decide to ban a user from Cubble, we accept no liability for unauthorized or illegal use of Cubble by its users.Links to other websites For the convenience of our visitors Cubble has included (automatic) links to external web pages. Also, users will have the option to place links in advertisements and in their public profile. You agree to do not copy, modify or distribute our copyrights and trademarks. By placing material on Cubble you authorize us to use it for publicity purposes of Cubble. By using our services you agree that your ads can be shown through other distribution channels such as updates via email or on the homepage. We have the right to delete your ad if we receive a message that it is unlawful, causing problems or otherwise violate any law and/or our Terms and Conditions. If you believe an infringement of your intellectual property rights has been made, please inform us via the contact form on the website and we will investigate the matter.Liability You agree to do not hold us responsible for what other users posted or did. Since most of the material on Cubble comes from other users, we do not guarantee the accuracy of postings or other messages, the quality, safety or legality of what is offered. Also we can not guarantee the permanent and/or secure access to our services. Therefore we exclude, to the extent permitted by law, all implied warranties and conditions in general. We are not liable for any loss of money, goodwill or reputation nor for any special, indirect or consequential damages resulting from your use of Cubble.
